Checking Regulatory Requirements for Import into Brazil

Primary source: Use the official Siscomex Administrative Treatment Simulator to determine the treatment applicable to the product/operation entered. Sector regulators’ official rules should then be checked where the Simulator identifies a responsible agency. The note is intended for preliminary information and exporters are requested to coordinate with Brazilian importers/partners for confirmation of the information.

Practically all imports into Brazil need one of the following:

Steps for exporters to find out regulatory requirements:

1. Confirm the Brazilian NCM
Identify the correct 8-digit Brazilian NCM from the product’s technical description. Do not assume that the final two digits of an Indian ITC(HS) code are automatically the same as the Brazilian NCM.

2. Check the official Siscomex Administrative Treatment Simulator
Enter the NCM and complete any product or operation attributes requested. The Simulator may show no licensing requirement, monitoring, an LPCO requirement, a responsible government agency, or a restriction/prohibition. Treat the live result for the information entered as the primary operational result. Exact search attributes to get the Administrative Treatment Numbers (TAs) in this step.

3. Understand what the result requires
If the Simulator shows an LPCO, note the agency, TA/LPCO model and any timing condition such as approval before shipment. LPCO means “Licenças, Permissões, Certificados e Outros Documentos” (Licences, Permits, Certificates and Other Documents). Not every import requires an LI or LPCO; the applicable administrative treatment determines whether such a document is needed.

4. Check the responsible regulator, if one is identified
Siscomex identifies the import-side administrative control, but it may not describe every product-registration, sanitary, conformity-assessment or technical requirement. Check the responsible regulator’s official rules before committing to shipment.

5. Confirm before shipment
The Brazilian importer or Brazilian partner should confirm the NCM, product attributes, applicable treatment and any pre-shipment requirement using the actual transaction details. If the import is being prepared some time after the first check, review recent Siscomex notices because treatments can change.

Example - NCM 29211121 (Dimethylamine): enter the NCM in the live Simulator and complete the requested attributes. If the live result returns TA I1125, use that result for the query entered and then follow any ANVISA requirements indicated.
